Who the heck knows. There are oodles of single cut shapes out there. I have no bloody idea what Gibson is trying to enforce anymore.

"Equity aids the vigilant, not those who slumber on their rights." If Gibson did not act to prevent copies of its designs being made, it would lose its right to those designs. It may only be a couple of copies each year, but it is a big principle in law.

Besides, Gibson's action has resulted in a new design, which surely is a good thing.

Yeah I reckon Gibson fires across the bows of "competitors" (however small) as a deterrent. It serves to demonstrate that they're vigilant and serious. And it maintains the perceived value of their $10K+ guitars.

A judgment that will go down in history: 'Finally, Gibson argues that, taken together, the initial-interest-confusion and post-sale-confusion doctrines should be extended to include something that we can only describe as a “smoky-bar theory of confusion”...Gibson does not suggest that consumer confusion as to the manufacturer of a PRS guitar would lead a potential purchaser to consider purchasing a PRS, rather than a Gibson, or that Gibson's reputation is harmed by poor-quality PRS guitars. The court's response:
If a budding musician sees an individual he or she admires playing a PRS guitar, but believes it to be a Gibson guitar, the logical result would be that the budding musician would go out and purchase a Gibson guitar.   Gibson is helped, rather than harmed, by any such confusion.

So, the Dusk Tiger is just GIbson's way of bolstering their lawsuit? Because they didn't have anything with a gaudy enough finish to be confused for a PRS? :moresarc:

The one I posted was from reverb… dude they do sell well. They’re probably pristine and never played, at least by a musician anyway
